CocoNaissance Holdings Corporation (“CocoNaissance,” “we,” “us,” or “our”) is a Philippine industrial holding company with its principal office at No. 84 Agrikultura Road, Barangay Tipacan, Lipa City, Batangas 4217, Philippines. Its businesses include Neeyog Resources Corporation, Biomassters Corporation, Ooleeng Carbon Corporation and CNH Renewable Energy Corporation.

This Website Privacy Notice explains how we collect, use, retain, disclose and protect personal data obtained through our corporate website at coconaissance.com.ph (the “Site”).

For personal data collected through the Site, CocoNaissance Holdings Corporation is the personal information controller.

We process personal data in accordance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (“DPA”), its Implementing Rules and Regulations, and applicable issuances of the National Privacy Commission (“NPC”).

This Notice applies only to personal data processed through the Site. It does not govern personal data collected through CocoNaissance’s employment, supplier, customer, investor, project-development, industrial or other offline and operational activities, which may be covered by separate privacy notices.

The Site is presently intended for corporate and institutional information and inquiries. It does not currently provide online sales, payment processing or user-account functionality.

2. Personal Data We Collect

2.1. Information You Provide

When you contact us through the Site’s inquiry form, we may collect:

Name: To identify you and address our response appropriately.
Organization (optional): To understand the capacity in which you are writing and route your inquiry appropriately.
Inquiry type: To categorize and route your inquiry.
Email address: To communicate with you and respond to your inquiry.
Telephone number (optional): To contact you about your inquiry where a telephone response is more appropriate or where we are unable to reach you by email.
Message: To understand, evaluate and respond to your inquiry.

Depending on the nature of your communication, your message may also contain information relating to your position or other details that you voluntarily provide.

Please do not include sensitive personal information, privileged information, government-issued identification numbers, financial-account information, passwords or other personal data that is not necessary for your inquiry.

If you voluntarily provide sensitive or additional personal information, we will process it only to the extent reasonably necessary to address your inquiry and as permitted by law.

2.2. Information Collected Automatically

When you access the Site, our web-hosting, network-security or related service providers may automatically generate technical records necessary to operate, secure and diagnose the Site. Depending on the Site’s configuration, these records may include:

Internet Protocol address;
Date and time of access;
Browser and device type;
Operating system;
Pages or resources requested;
Referring website;
Error and diagnostic information; and
Security-event information.

We use this information only for Site operation, security, troubleshooting, performance management and the investigation of suspected misuse or security incidents.

2.3. Google Maps

The Contact page may display an embedded Google map showing CocoNaissance’s office location. When the map loads, your browser may transmit technical information, including your Internet Protocol address and device information, directly to Google.

2.4. Google Fonts

Every page of the Site uses two typefaces, Archivo and Source Serif 4, which are delivered by Google Fonts rather than hosted on our own servers. When a page loads, your browser therefore makes a direct request to Google’s servers at fonts.googleapis.com and fonts.gstatic.com, and Google may process technical information, including your Internet Protocol address, browser and device information, as part of delivering those font files.

This occurs on every page of the Site, not only on the Contact page, and it happens whether or not you submit an inquiry. CocoNaissance does not receive or store the information transmitted in these requests. Google processes it under its own terms and privacy practices, described in Google’s Privacy Policy.

2.5. reCAPTCHA

The contact form on this Site is protected by Google reCAPTCHA, which distinguishes genuine inquiries from automated submissions. When you use the form, your browser transmits technical information to Google, which may include your Internet Protocol address, device and browser information, and details of your interaction with the Site. Google uses this information to assess whether the submission is likely to be automated.

This processing is necessary for the security and integrity of the Site and to prevent misuse of the contact form. Your use of reCAPTCHA is subject to Google’s Privacy Policy and Google’s Terms of Service.

3. Purposes of Processing

We may process personal data collected through the Site to:

Receive, evaluate, route and respond to inquiries;
Communicate with persons who contact CocoNaissance;
Evaluate legitimate business, supplier, partnership or institutional proposals;
Maintain records of corporate communications;
Operate, administer, secure and improve the Site;
Detect, prevent and investigate fraud, misuse and security incidents;
Establish, exercise or defend legal claims;
Comply with legal, regulatory and reporting obligations; and
Protect the rights, property and safety of CocoNaissance, its personnel, Site users and the public.

We do not use personal data collected through the Site for automated decision-making or profiling that produces legal or similarly significant effects.

We will not use personal data for a materially different or incompatible purpose without an appropriate legal basis and, when required, additional notice or consent.

4. Legal Bases for Processing

Depending on the circumstances, we may rely on one or more of the following legal bases:

Consent: When you have freely and specifically agreed to the processing of your personal data for a stated purpose.
Legitimate interests: When processing is reasonably necessary to receive and respond to communications, manage legitimate business relationships, operate and secure the Site, prevent misuse or protect CocoNaissance’s lawful interests, provided that those interests do not override your fundamental rights and freedoms.
Steps taken at your request: When processing is necessary to evaluate or respond to a request before entering into a contract or business arrangement.
Contractual necessity: When processing is necessary to perform an agreement to which you are a party.
Legal obligation: When processing is required for CocoNaissance to comply with applicable law, regulation or a valid order of a court or government authority.
Legal claims: When processing is necessary to establish, exercise or defend legal claims or protect lawful rights and interests.

Where sensitive personal information is involved, we will process it only when permitted under Section 13 of the DPA or another applicable law.

5. Disclosure of Personal Data

We do not sell or rent personal data. We do not disclose personal data collected through the Site to third parties for their independent direct-marketing purposes.

Where reasonably necessary and legally permitted, we may disclose personal data to:

Authorized CocoNaissance directors, officers, employees and representatives;
The CocoNaissance business or operating unit responsible for the subject of your inquiry;
A CocoNaissance subsidiary or affiliated company when necessary to address an inquiry concerning its operations;
Website-hosting, email, information-technology, cybersecurity and form-processing service providers;
Accountants, auditors, lawyers, insurers and other professional advisers;
Government agencies, regulators, courts and law-enforcement authorities; and
Other parties necessary to protect CocoNaissance’s lawful rights, property, personnel or operations.

Service providers processing personal data on our behalf are required to process it only for authorized purposes and to maintain appropriate confidentiality and security measures.

A separate entity receiving personal data for its own purposes may act as an independent personal information controller and may provide a separate privacy notice where appropriate.

6. International Processing and Transfers

Some of CocoNaissance’s technology, hosting, email or professional-service providers may store or process information using systems located outside the Philippines.

When personal data is transferred or made accessible outside the Philippines, CocoNaissance remains responsible for ensuring that the processing is conducted in accordance with the DPA. We take reasonable steps to require appropriate contractual, organizational and technical safeguards from relevant service providers.

7. Data Retention

We retain personal data only for as long as reasonably necessary to fulfill the purpose for which it was collected, comply with legal and regulatory obligations, resolve disputes, enforce agreements and establish or defend legal claims.

Unless a longer period is justified or required:

Ordinary inquiries may be retained for up to 12 months after the inquiry is resolved.
Records relating to active or prospective business, supplier or partnership arrangements may be retained for the duration of the discussions and for up to three years afterward.
Technical security and access records may ordinarily be retained for 30 to 90 days, unless they are required for an investigation, legal proceeding or security incident.
Records connected with complaints, disputes, legal obligations or claims may be retained until the matter is finally resolved and for the applicable legal-preservation period.

At the end of the applicable retention period, personal data will be securely deleted, destroyed or anonymized, unless continued retention is required or permitted by law.

8. Cookies and Similar Technologies

CocoNaissance does not currently use cookies or similar technologies for behavioral advertising, visitor profiling or cross-site tracking.

The Site may use strictly necessary technologies required for security, network management or essential Site functions. Third-party content and resources, such as the embedded Google map on the Contact page, the Google Fonts typefaces used across the Site and the Google reCAPTCHA protection on the contact form (Sections 2.3, 2.4 and 2.5), may also use cookies or collect technical information under the third party’s own privacy practices.

If CocoNaissance introduces analytics, advertising or other non-essential tracking technologies, this Notice will be updated before their implementation. Where required, visitors will be given an appropriate choice or consent mechanism.

You may also manage or block cookies using your browser settings. Blocking essential technologies may affect certain Site functions.

9. Security

CocoNaissance implements reasonable and appropriate organizational, physical and technical safeguards designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, misuse or access.

Depending on the nature and risk of the processing, these safeguards may include:

Encrypted transmission through HTTPS;
Access restrictions and authentication controls;
Confidentiality obligations for authorized personnel;
Secure system and service configuration;
Service-provider assessment and oversight;
Backup and recovery measures;
Security monitoring; and
Security-incident and personal-data-breach response procedures.

No internet transmission or information-storage system can be guaranteed to be completely secure. Visitors should therefore avoid sending unnecessary or highly sensitive information through the Site’s general inquiry form.

10. Your Rights as a Data Subject

Subject to the conditions, limitations and exceptions provided by the DPA, its Implementing Rules and Regulations and applicable NPC issuances, you may have the right to:

Access personal data that CocoNaissance holds about you;
Object to certain processing of your personal data;
Withdraw consent where processing is based on consent, without affecting processing lawfully undertaken before withdrawal;
Correct or rectify inaccurate, incomplete or outdated personal data;
Request erasure or blocking when the legal conditions for erasure or blocking are satisfied;
Data portability where the processing and information concerned meet the applicable statutory requirements;
Be indemnified for damage sustained as a result of a violation of your rights under applicable data-protection law; and
File a complaint with the National Privacy Commission.

CocoNaissance may request reasonable information to verify your identity and authority before acting on a request. We may also decline or limit a request when permitted or required by law and will explain the applicable reason where appropriate.

To exercise a data-subject right or raise a privacy concern, please contact CocoNaissance’s Data Protection Officer using the details below.

Your request should, where possible, include:

Your full name and contact information;
A description of your request or concern;
The relevant interaction or communication with CocoNaissance; and
Any information reasonably necessary to locate the applicable record and verify your identity.

We will acknowledge, evaluate and respond to your request within the period required by applicable law.

12. Children’s Privacy

The Site is intended primarily for business, professional and institutional users and is not designed or directed toward children.

CocoNaissance does not intentionally solicit personal data from children through the Site. If you believe that a child has submitted personal data through the Site without appropriate authorization, please contact our Data Protection Officer so that we can evaluate and address the matter.

13. Changes to This Notice

We may update this Website Privacy Notice to reflect changes in our practices, Site functionality, service providers or legal obligations.

The effective date and last-updated date shown at the beginning of this Notice indicate when the current version took effect. Material changes may also be communicated through an appropriate notice on the Site.
